The conditions described below regulate the relationship between the aforementioned company and the customer. Therefore, when contracting tourist entertainment services, it is assumed that the client is aware of and accepts these conditions. The general conditions described here may be supplemented by specific conditions sent to the customer, and the specific conditions complement and override the general conditions.
Access to this website is permitted on a temporary basis and we reserve the right to withdraw or change services and content without prior notice. We will not be liable if for any reason this website is unavailable for any period of time. We may occasionally restrict access to some areas of it.

LAW AND JURISDICTION
This website was created and operates under the terms of Portuguese Law. Access to this website is subject to acceptance of these conditions and any dispute relating to it will be regulated by current Portuguese legislation, with only the courts in the district of Lisbon having jurisdiction, expressly waiving any other. If any of the conditions are considered, by virtue of a court decision, null, illegal or inapplicable, this will not affect the other conditions, which will remain valid to the maximum extent legally permitted.
SCHEDULE
Service proposals (price, location, other information) will only be valid for the dates presented in the proposal. The description of each service on our website and in personalized proposals sent to customers is abbreviated but as explicit as possible. However, the content and format of the services may undergo slight changes, depending on the time of year and weather conditions. Possible changes will be communicated when confirming your reservation. The activity programs provided to customers include a detailed description of the activities, such as standards of conduct, general and specific conditions, prices, Clean & Safe recommendations, among other information. Participants in activities must, therefore, be aware of the repetitive activity program.
PRIVATE GROUPS
Proposals for private groups/companies follow a prior budget and are dependent on agenda availability of Living Place – Animação Turística. The proposed values depend on the number of people, chosen destination, duration of the event, costs of hotels, restaurants, transport, among other variable factors.
TIME
The duration of the activities is given only as an indication and approximately, depending on factors external to the guides. A 5-minute grace period will be allowed for all participants to meet at the meeting point defined for each program and activity.
BOOKING/PAYMENT
All activities and programs on the Living Place – Animação Turística website are owned and marketed by Living Place – Animação Turística.
To sign up for any Living Place – Animação Turística activity, must carry out, necessarily, your reservation, via the reservation form on our website – livingplace.pt – or to email mailto:geral@livingplace.pt, meaning that in this act you are purchasing the requested service and agreeing to the General and Specific Conditions of the activity. In this way, you undertake to pay for all services provided in the activity for which you made your reservation.
After making the reservation, you must pay for the activity you signed up for. Payment must be made in advance by bank transfer or MBWay. Prior payment for activities, when requested, must be made by bank transfer to the IBAN or MBWay indicated in the email you will receive in response to your reservation, requiring you to send the respective receipt to the email mailto:geral@livingplace.pt
At the time of registration/reservation, the Customer assumes some commitments to the Living Place – Animação Turística:
- Having read and accepted these Terms and Conditions of participation, as well as the program of the activity in which the Customer signs up, which constitute the particular conditions of participation in the activity.
- Who is in adequate health conditions for the activity in which he is involved and accepts the nature of it, in particular the risks arising from the impossibility of immediate access to medical assistance.
- You must always notify the Living Place – Animação Turística if you suffer from any chronic illness or other that prevents you from practicing this activity. If you have permission from your doctor to participate, you will have to provide us with a medical certificate.
- That you are aware of the type of physical and psychological demands that the activity involves and that could lead to extreme and unforeseen situations.
REFUNDS AND CANCELLATIONS/ CHANGES/ CANCELLATION
In case of need to cancel an activity, for reasons beyond our control (for example: extreme weather conditions that put the safety of participants at risk), we will notify you as soon as possible and will make every effort to present you with an alternative date that suits you or, in some cases, a full refund of the reservation amount may be possible, if there are no commitments already made with third parties.
The Living Place – Animação Turística reserves the right to cancel activities in the following cases:
- The minimum participants required for each activity are not met;
- Weather or other conditions make it impractical;
- Safety conditions are not met;
- The conditions set out in the particular conditions are not met;
The carrying out of many activities is dependent on weather conditions. If any activity is canceled due to weather conditions, you will be offered a new booking but always subject to the weather conditions of the respective day.
If the customer cancels the reservation, they may receive a full refund of their payment under the following conditions:
- In the case of activities lasting only 1 day, you will receive a full refund if you cancel up to 72 hours before the start of the activity and if the Living Place – Animação Turística, following the reservation made, has not already made commitments to other operators involved in the activity.
- In the case of sold out events, Living Place – Animação Turística does not refund amounts already paid
- In activities lasting more than 1 day and taking place in Continental National territory, cancellation must be made up to 30 days before the start of the activity, otherwise you may incur payment of expenses already incurred, or total loss of the amount paid.
- In activities lasting more than 1 day and taking place on the Islands (Azores and Madeira) and outside the National territory, cancellation must be made up to 45 days before the start of the activity, otherwise you may incur the payment of expenses already incurred, or total loss of the amount paid.
TRANSPORT
The itineraries are included in the programs only as an indication and the route is subject to change. The services we provide, unless expressly stated otherwise, do not include any type of transport or transfer.
SAFETY RULES
The Living Place – Animação Turística activities, comply with safety standards, reducing the risks associated with the activities we carry out. However, participants must bear in mind that due to the nature of the activities the risk cannot be reduced in its entirety.
Participants in activities Living Place – Animação Turística, must commit to following certain rules of conduct, which respect their own safety, that of other people (participants in the activities or not) and nature. The company Living Place – Animação Turística and its employees will not be responsible for inappropriate behavior of participants during activities, but may, however, terminate an activity if safety conditions or minimum standards of conduct are questioned.
It is the customer's responsibility to ensure that they are in good health to carry out their respective activities. Certain activities require the verification of certain conditions in the person carrying them out, such as minimum age, health status and other physical and psychological requirements.
When possible, such restrictions will be indicated in the proposal sent to the client, and it is advisable to read them carefully upon receipt.

Accidents and Activation of Personal Accident Insurance (PAI)
All insurance held by Living Place – Animação Turística will be able to be activated within the period of time in which the activity/program in which the Customer has signed up takes place. This period of time is stipulated as the beginning of the date and time described in the program and will end on the day and time on which the Client abandons the activity/program, even if they leave it early and definitively or resume it later. Whenever the Client wishes to abandon the activity/program, he or she must inform the Living Place - Animação Turística Guide.
Accidents subject to PAI action are considered to be all those that occur as a result of the normal development of the activity described in the program in which the Customer is participating or any changes introduced to it by the Living Place – Animação Turística.
Accidents may not be subject to PAI activation in the following circumstances:
When the Client, on his/her own initiative, is carrying out some activity outside the scope and normal development of the activity described in the program or following risk behaviors that are unnecessary to the activity in which the Client is participating.
When the Customer, on its own initiative and against the instructions of the Living Place - Animação Turística Guide responsible for the activity on the ground, decide to make changes to the route or to the program described and in which the Customer is participating.
When any safety rule previously established by the Living Place - Animação Turística Guide is knowingly overcome by the Customer.
Any and all Accidents that may be triggered by the PAI must be reported to the Insurance Company, within a maximum of 72 hours after the conclusion of the activity in which the accident occurred.
OTHER INFORMATION
All content on the website Living Place – Animação Turística (texts, photographs and information) is protected by copyright and cannot be used without prior authorization from Living Place – Animação Turística. The images collected by participants during the activities carried out by Living Place – Animação Turística may be used for the purpose of promoting its services on our website and social networks. If you do not agree with this policy, you must inform the company by email (geral@livingplace.pt) that you do not authorize the use of your photos in advertising our events, in the website gallery and social networks. If you want to see your images published with your credits, you must always put your name on the images you send us.
